GENERAL TERMS OF SALES
Ownership of the site: the site is the property of the company MY-DECO-SHOP EUREKA SÀRL in its totality, as well as all related rights. Any reproduction, full or partial, is prohibited unless express and prior authorization by MY-DECO-SHOP EUREKA SÀRL.
1. Acceptance of the general terms of sales
The customer acknowledges having read, prior to placing the order, the general terms of sales stated on this screen and expressly states to accept them without reserve. The present general terms of sales govern the contractual relationship between my-deco-shop and its client. They will prevail over all other conditions contained in any other document, except prior, express and written waiver of my-deco-shop.
The present general terms of sales can be modified at any time by MY-DECO-SHOP, without notice. The applicable conditions will be those in force on the site at the time of the validation of the order.
Automatic registration systems are considered to be proof of the nature and content of the order. MY-DECO-SHOP confirms the acceptance of its order to the customer to the e-mail address that he will have communicated. The sale will be concluded as from the validation by MY-DECO-SHOP of the payment of the order that is the payment validation date for orders paid online by credit card or the date of receipt of payment by bank transfer or check. MY-DECO-SHOP reserves in any case the right to refuse or cancel any order from a customer with whom there would be a dispute over the payment of a previous order.
3. Price and payment
The price is expressed by default in Euros and all taxes included. It is expressed excluding taxes for countries outside the European Union.
In order to facilitate the understanding of the values, we propose the display of prices in multiple currencies. Exchange rates are updated automatically and on a regular basis.
The payment of your order is done in euros.
The price indicated on the descriptive of the products does not include the price of transport. The cost of transport varies depending on the address to which the delivery will be made but also depending on the product or products ordered.
The price corresponding to the transport costs is indicated in the summary of your basket. It may be estimative for some distant destinations. This transport price usually includes standard customs formalities (export and / or import). The volume of certain products has a direct impact on the delivery price of these products. In the case where the transport price calculated automatically by the system is undervalued, we inform you immediately. In this case, we reserve the right to suspend the execution of the order, and we are submitting you a most advantageous possible transport offer. If the price of transportation is overvalued by the system, we are committed to refund you the difference. We are always looking for the most advantageous transport solution for you, taking into account your criteria (speed, priorities). We invite you to contact us for any specific request related to transportation costs: we will be happy to answer your requests for transport quotes within 24 to 48 hours maximum. Similarly, some destinations require particular customs procedures. We are able to give you a precise answer on these points, and we will, in the majority of cases, proceed to the necessary administrative procedures. If any fees apply as part of these steps, we inform you in advance, and wait for your agreement to launch the customs clearance procedures. Some regions or countries apply additional taxes for the importation of certain products (eg sea granting or local taxes). These costs are payable to the competent authorities by the recipient upon delivery of orders.
The price indicated in the order confirmation is expressed all taxes included and includes VAT for France and the EEC countries. It is expressed excluding VAT for countries outside the European Union. The price indicated in the order confirmation includes the price of the products, handling charges, packing, transportation costs, and transportation insurance.
Customs and local taxes are not included in this amount.
The price is payable in cash on the day of the order confirmation.
For customers benefiting from a bank domiciliation in France, it is possible to choose a method of payment by check in 3 times without fees (subject to acceptance of your checks by our control organization "Check Guarantee Service - Atos World Line").
Different payment options are offered to you:
* by bank card bearing the acronym CB, online. Cybermut allows you to pay via a CREDIT MUTUEL bank server in a secure environment. Your bank card number is then sent to the bank's servers and then to YOUR bank's server, your payment being made directly on the secure space of your bank, without going through the shop's server. A guarantee all the more important that your information is known only by your banking partner.
The order will be automatically canceled, and the customer notified by email in the assumption that the bank payment center concerned has refused to give its consent.
The 3DSecure security protocol.
The implementation of this 3DSecure procedure, which cannot be considered as a guarantee against any fraudulent use of credit card and could not engage the responsibility of MY-DECO-SHOP, differs the validation of the payment until the end of the verification procedure. It may lead to the cancellation of the order.

It is totally secure and used by millions of consumers around the world. You do not have to be registered with PAYPAL to use their online payment services.
* by phone: contact us on +33 03 88 07 23 92 (price of a local call in France) - and arm yourself of your credit card. This solution is ideal for those who do not want to use the internet network for its regulations.
* by bank transfer: an email containing our bank details will be sent automatically when you choose this option.
Payments made cannot be considered as a deposit. Any late payment automatically entails the payment of late interest corresponding to one and a half times the legal interest rate.
4. Retention of title clause
By express agreement, and in accordance with the provisions of the law of May 12th 1980, the products ordered remain the property of MY-DECO-SHOP until full payment of their price by the customer. In case of non-fulfillment of its obligations by the customer, whatever the cause, MY-DECO-SHOP will be entitled to demand the immediate return of the products at the expense, risk and peril of the customer.
5. Availability and shipping of products
All deadlines announced on the MY-DECO-SHOP website are in working days (excluding Saturdays, Sundays and public holidays).
Each product sheet indicates:
* Either the presence in stock of the product concerned: the indication "in stock" corresponds to the stock status at MY-DECO-SHOP at the time of the order.
* Either an availability delay: the delay of availability corresponds to the time of supply in stock at MY-DECO-SHOP. This delay is communicated by the supplier and / or the manufacturer of the product and varies according to the type of product. This delay of availability, applies, for example, for any product made to measure, according to the colors or materials chosen by you.
* Either the mention "pre-order": the products concerned are new products announced by the supplier and / or the manufacturer, with no precise known date of availability.
* Either the mention "rupture": the product is momentarily unavailable from the supplier.
Orders are processed, prepared and shipped, that is to say delivered to our carrier, within 1 to 2 working days from:
* The reception of the product by MY-DECO-SHOP, regarding the products in availability,
* The validation of the payment by the customer when it is realized by credit card online or the receipt of payments made by bank transfer or check, regarding the products in stock at the time of this validation or receipt,
* The receipt of products by MY-DECO-SHOP, when these actually become available from the supplier, regarding pre-order or unavailable products at the time of the validation of the order.
Generally speaking, orders are processed after payment validation when paid online by credit card or upon receipt by MY-DECO-SHOP of the payment when the customer has chosen a payment by bank transfer or check. The "in stock" indications and the times of availability are likely to vary between the date of the order and, depending on the case, the date of validation of the payment by credit card or the date of receipt of the transfer or check.
Availability times are subject to change at the initiative of the supplier and / or the manufacturer.
In such cases, the deadlines of availability will be those in effect at the time of payment by credit card or at the moment of the reception of the transfer or the check.
In case of unavailability of products at our suppliers:
* definitive unavailability: MY-DECO-SHOP undertakes to offer the customer replacement items or to refund the missing items, without delay and at the latest in the 30 days in accordance with the provisions of Article L121-20-3 of the Code of Consumption.
* temporary unavailability: MY-DECO-SHOP informs the customer of the date on which the product will be available again. The customer then has the possibility to maintain his order with these new deadlines or to cancel it. In the latter case, MY-DECO-SHOP undertakes to refund the missing items without delay and at the latest within 30 days in accordance with the provisions of Article L121-20-3 of the Code of Consumption. Shipments to DOM-TOM or countries outside the European Union will be subject to acceptance of the package in the hold.
During holidays (in summer during the months of July and August, and in winter, during the end of the year holidays), the period of availability of products may be extended from a few days to 4 weeks, depending on the holiday period of the manufacturers. Of course, we inform you of this delay in the delivery of your order as soon as we have taken cognizance of it. Manufacturers not taking holidays at the same time, it is impossible to predict this delay in advance. We invite you to contact us by phone or email, especially during these periods of leave, in order to know precisely the delay of manufacture or availability of products.
The delivery of the orders is carried out by independent providers of the company MY-DECO-SHOP and within the deadlines announced by these providers. The delays announced by these providers are usually 48-72h for parcels under 30kg and over 72h for parcels over 30kg. International delivery times range from 2 to 30 days, depending on the transport options you have chosen.
To report to MY-DECO-SHOP any difficulty related to the delivery, the customer has a free online order tracking, accessible via the detail of the order, but also a customer service available 7 days a week, 24 hours a day. You can reach the customer service, either by email (firstname.lastname@example.org), or by phone on +33 (0) 3 88 07 23 92 (from 9h to 22h, every day).
MY-DECO-SHOP is committed to do what's necessary so that orders are shipped within 30 days (60 days for some made-to-measure items) of the validation of the payment by credit card online or the reception of the payments by transfer or by check. The carrier undertakes, by contract with MY-DECO-SHOP, to deliver the order to the address of the buyer transmitted by MY-DECO-SHOP.
In addition, for deliveries outside metropolitan France, the customer agrees to pay all taxes due on the importation of products, customs duty, value added tax, and any other taxes due under the laws of the country of receipt of the order. All orders placed at MY-DECO-SHOP are for the personal use of customers, the customers or the recipients of the products are prohibited any partial or total resale of the products. MY-DECO-SHOP cannot be held responsible for the failure to acknowledge taxes for payment for which the customer is liable.
In Metropolitan France, delivery will be made either by La Poste in Colissimo followed, Chronopost, UPS, GEODIS or DSV. In the EEC countries, deliveries are made by La Poste in Europe Colissimo followed, GEODIS, DSV, FEDEX, DHL, TNT, or also UPS depending on the customer's choice or the most competitive offer at the time of order. Deliveries outside the EEC are made by the international postal services, Chronopost, or UPS, DHL, FEDEX or TNT according to the choice of the customer or the most competitive offer at the time of the order. For reasons of availability, an order can be delivered in several times. The decision to deliver your order in several times belongs to us. In this case, the shipping costs will not be increased.
Whatever the place of delivery, this is done in the time slot provided with the customer by the direct delivery of the product to the intended recipient, either in case of absence, to another person authorized for this purpose by the client. In the absence of any recipient, a notice of passage is left at the delivery address. Eventual costs of new presentations are the responsibility of the customer. The customer is required to check the condition of the products upon receipt. In case of damage, he must mention precisely his reservations on the delivery note and reiterate them with the carrier by registered letter with acknowledgment of receipt within three (3) days of delivery in accordance with the provisions of Article L.133-3 of the Commercial Code. He must furthermore inform MY-DECO-SHOP by registered letter with acknowledgment of receipt of any shipping damages within eight (8) days after receipt. No complaint will be accepted in case of non-compliance with these formalities. If home delivery is not possible, the order will be made available to you at a collection point near your address.
MY-DECO-SHOP will, in any case, be released from its obligation to deliver in case of:
* the occurrence of a case of force majeure such as in particular the war, riot, fire, strikes, accidents and the impossibility of being supplied,
* non-performance by the customer of any of his obligations (payment of the price, accuracy of the information communicated by the customer such as the delivery address, or any information required by the customs authorities of the country of destination)
All the technical articles benefit, from the manufacturer, of a contractual guarantee of one year minimum. Some are guaranteed 2 years, 5 years or more (see in the description of each article). The eventual extensions of guarantees offered, which are the subject of a separate invoice validated by the customer, are only valid in Metropolitan France and Corsica.
All returns must be preceded by the prior agreement of MY-DECO-SHOP and the allocation of a return number.

Failing prior agreement, assigning a return number or when sending to any other address of MY-DECO-SHOP, the goods will be returned to the customer postage due. Returned products must be accompanied by their original packaging.
In all cases, the customer benefits from the legal guarantee of hidden defects (Art.1626 and following of the Civil Code). Provided the buyer proves the hidden defect, the seller must legally repair all the consequences (art.1641 and following of the civil code).
Are excluded from any guarantee:
1. Uses and maintenance not in accordance with the instructions for use delivered with the product as well as defects in use (or maintenance) or accidental breakage.
2. Damage due to an error of mishandling, of connection (whether made with original accessories or with other accessories substituted by the customer), to an abuse or abnormal use, to an intentional or accidental physical modification, to a use for professional or commercial purposes.
3. Spare parts or accessories whose replacement results from their normal wear, or routine maintenance operations: bulbs, etc...
4. The cost of transport and modification of the device, in case of recall by the manufacturer for series defect.
5. The damage due to an external event (lightning, water damage, etc...).
6. The interventions made on the device by any person not mandated by the After-Sales Service as well as the malfunctions and deteriorations resulting from such an intervention.
8. Limitation of liability
The information given on the site, photographs, product sheets, prices of products and transport are given as an indication. MY-DECO-SHOP strives to ensure the accuracy of the information presented on the site. The errors likely to have been introduced are fortuitous and are rectified as soon as possible. The responsibility of MY-DECO-SHOP cannot be blamed for simple errors or omissions that may have persisted despite all the precautions taken in the presentation of the products. It is the same for the possible modifications of the products decided by the manufacturers. It is furthermore possible to display the different information presented on the pages in 13 different languages. The responsibility of MY-DECO-SHOP cannot be blamed in case of misunderstanding or error of translation of this information. We invite you to refer to the English or French versions to validate the descriptions in case of doubt.
In accordance with the texts in force, MY-DECO-SHOP is not responsible for the non-performance or the bad execution of the contract that would be attributable either to the consumer, either to the insurmountable and unpredictable fact of a third-party contract or a case of force majeure.
In accordance with Articles L.121-20 and following of the French Consumer Code and the new European provisions the European consumer has fourteen days from the date of receipt of the order to return, at its expense, the product in its original packaging for replacement or refund. The returned product will only be accepted if the product has not been deconditioned or used and returned to new condition. Products sold in blister or with a warranty label must be returned as is.
Are excluded from this warranty of withdrawal, all custom made products, following the instructions or options selected by the customer when confirming the order and requiring specific manufacturing (a table made to measure for example, or a custom sofa made in a fabric chosen according to your instructions). These products are available after the time necessary for their manufacture and are presented on the site with a mention of production lead time from 2 to 16 weeks. The choice of a material or colors specifically chosen by the customer for the ordered product, but also the association of colors, or association of specific furniture, are considered as an order of custom made products.
Also excluded from this possibility of return, and for obvious reasons of hygiene, futons, mattresses and similar items, such as Armchairs-Futons. These articles are neither taken back nor exchanged.
The provisions related to the withdrawal do not apply to businesses or professionals.
Only individuals can benefit from the right of withdrawal (Articles L.121-20 and following of the French Consumer Code).
The consumer informs, before the expiry of the withdrawal period, of his wish to withdraw from the contract. To do so, the consumer has the possibility, either to send an email to email@example.com, either to send a mail to the address below:

MY-DECO-SHOP sends the consumer a return number, number that must appear clearly near the consignee label affixed to the package. If the consumer does not inform MY-DECO-SHOP beforehand of his desire to retract, the package will be refused and returned to the consumer.
The consumer returns or gives back the goods to MY-DECO-SHOP, at the latest fourteen days following the communication of his decision to withdraw from the contract. MY-DECO-SHOP undertakes to check, upon receipt of the parcel in return, the condition of the goods, and to reimburse the consumer within a reasonable time. In the case where the returned product is not returned in its new condition, a depreciation may apply during the refund of the product. It is up to the consumer to take all necessary measures to ensure that the returned product is returned in an irreproachable condition. MY-DECO-SHOP encourages the consumer wishing to return a product, to take a transport damage insurance to guard against any damage that may occur during transport.
MY-DECO-SHOP refunds all payments received from the consumer, except, if applicable, the initial delivery costs. The refund is made using the same payment method used by the consumer during the validation of his order (except express agreement of the consumer for another means of payment and provided that the reimbursement does not involve any costs for the consumer).
10. Legal information
The personal information relating to the customer is essential for the processing and delivery of orders, the establishment of invoices and guarantee contracts. The lack of information leads to the non-validation of the order. In accordance with the law "Informatique et Libertés", the processing of personal information relating to customers has been declared to the Commission Nationale de l'Informatique et des Libertés (CNIL).
The customer has (article 34 of the law of January 6, 1978) a right of access, modification, rectification and deletion of data concerning him, that he can practice with MY-DECO-SHOP. In addition, MY-DECO-SHOP undertakes not to communicate, free of charge or in return, the details of its customers to a third-party.
11. Commitment to data protection
In accordance with the provisions of Law No. 98-536 of 1 July 1998, transposing into the Intellectual Property Code of the Directive 96/9/CE of March 11th 1996, concerning the legal protection of databases, MY-DECO-SHOP is the producer and owner of all or part of the databases that make up this site. By accessing this site, the customer recognizes that the data component is legally protected, and, in accordance with the provisions of the aforementioned Act of 1 July 1998, forbids in particular to extract, reuse, store, reproduce, represent or conserve, directly or indirectly, on any type of support, by any means and in any form whatsoever, all or part qualitatively or quantitatively substantial, of the contents of the databases appearing on the site to which it has access.
12. Operation "Site Evaluated - Premium Site"
Your purchase on MY-DECO-SHOP offers you the opportunity to participate in the operation "Site rated - Trusted Site" organized by TRUSTED SHOPS.

Partial responses or no response to one or both satisfaction surveys have no impact on the progress of your order and its treatment.
TRUSTED SHOPS and MY-DECO-SHOP are the recipients of the nominative data collected within these satisfaction surveys.
Non nominative data will be exploited by TRUSTED SHOPS in accordance with the regulations in force and in particular the one relating to the protection of personal data.

13. Applicable law
The present contract is subject to French law.
